Used Firearms Sales Policy 

At PCF Guns and Gear (Poverty Creek Firearms LLC), we take pride in providing high-quality used firearms. To ensure transparency and fairness in our sales process, please review the following policy regarding used firearm purchases: 

1. All Sales Are Final 

• The sale of used firearms is final upon shipment. No returns, refunds, or exchanges will be accepted once the firearm has left our facility. 

2. Detailed Inspection Before Posted for Sale 

• We strive to provide accurate descriptions and clear photos of all used firearms. Customers are encouraged to review all product details carefully before making a purchase. 
• If additional information or photos are needed, please contact us before placing an order. 

3. No Warranty or Guarantees

• Used firearms are sold as-is, with no warranty, express or implied, unless otherwise stated in the product listing. 
• The buyer assumes all responsibility for the firearm’s condition, safety, and functionality upon purchase. 

4. Defective or Misrepresented Items 

• If a firearm is found to be significantly different from the description provided at the time of sale, the buyer must notify us within 48 hours of delivery. 
• We will review claims on a case-by-case basis, but refunds or replacements are not guaranteed. 

5. Compliance with Laws 

• Buyers are responsible for ensuring they comply with all federal, state, and local firearm laws before purchasing a used firearm. 
• Firearms will only be shipped to a verified Federal Firearms License (FFL) dealer. 

6. Limitation of Liability 

• To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase of a used gun from us, including but not limited to loss of profit, data, or business. 
• In addition, we are not liable, in any way, monetarily or otherwise, for any damage to personal property, injury, or loss of life due to the improper use of any firearm or other product purchased from our site. Improper uses include but are not limited to accidental or negligent discharges, unsafe operation, or illegal actions. 
• Furthermore, it is your responsibility as the buyer of any used gun, to have it inspected by a certified gunsmith thoroughly before attempting to fire it. We inspect every used firearm we list for safe operation and will not list any firearm on our site we deem unsafe to shoot. Again, we are confident in our work and inspections; however, we strongly recommend having a certified gunsmith reinspect before shooting any used firearm regardless of where it’s bought from.
