1. Introduction

Welcome to PCF Guns and Gear (Poverty Creek Firearms) (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of our website, www.povertycreekfirearms.com, and any related services, including but not limited to the purchase of firearms, ammunition, and related products (collectively, the “Services”). By using our website, you agree to comply with these Terms and all applicable laws and regulations. If you do not agree with these Terms, please do not use our website. 

2. Eligibility

You must be at least You must be at least 18 years of age to buy long guns any other products, and 21 years of age to buy handguns and handgun ammunition from our website. By making a purchase, you confirm that you are of legal age to do so and meet all legal requirements for firearm possession in your jurisdiction. You are also responsible for ensuring that you comply with all federal, state, and local laws regarding firearm ownership, transfer, and possession. 

3. User Account

To purchase products from our website, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities under your account. You agree to notify us immediately if you suspect any unauthorized use of your account. 

4. Product Listings and Availability

We make every effort to accurately describe the products listed on our website. However, we do not guarantee that product descriptions, pricing, or availability are error-free. All firearms and ammunition sales are subject to availability. We reserve the right to limit quantities, refuse or cancel orders, or modify or discontinue products at our sole discretion. 

5. Ordering and Payment

By placing an order through our website, you make an offer to purchase the products in your cart. All orders are subject to acceptance by us, and we reserve the right to refuse or cancel any order for any reason. We accept payment through Visa, MasterCard, Discover, and American Express, and by submitting your payment information, you authorize us to charge your payment method for the total amount of your order, including applicable taxes and shipping fees. 

6. Age Verification and Background Checks

In compliance with federal, state, and local laws, we require age verification and background checks for all firearm purchases. By placing an order for firearms or ammunition, you consent to the completion of a background check at your designated Federal Firearms Licensee (FFL), which may be conducted by the licensed firearms dealer or other authorized party. If you fail the background check, your order will be forfeited to said FFL, a refund may be processed, minus a restocking fee, once the item has been returned. In an event that this does happen, contact us for a return merchandise authorization (RMA) number, coordinate shipping the product back through your designated FFL, and you will be responsible for any incurred shipping costs.  

7. Shipping and Delivery

We will ship non-firearm products to the address you provide at checkout, firearms (and possibly ammunition depending on your jurisdiction) must be shipped to an FFL of your choosing. Firearms and ammunition shipments may be subject to additional regulations and restrictions based on your location. You agree to provide accurate shipping information and understand that delivery may take longer due to FFL verification, background checks, age verification, or other legal requirements. 

It is your responsibility to ensure that the delivery address is within a jurisdiction that allows the legal receipt of firearms and ammunition. We are not liable for any delays, damages, or failure to deliver due to issues related to your shipping address or local laws. 

It is your responsibility to ensure and verify the products you purchase are legal in your area. Any orders of product that has been banned in your area will be canceled. In the case that a firearm component, such as a “high-capacity magazine” is banned in your area, the firearm will not be shipped with a magazine, if a compliant magazine is available, it will be provided. If one is not available, contact us for a credit of the magazine cost. 

8. Return and Refund Policy

Due to the nature of our products, we typically do not accept returns for firearms, ammunition, or any other restricted items, except as required by law. In the event of an error on our part (e.g., incorrect product or damage during shipping), we will provide a refund or replacement as appropriate.

9. Legal Compliance

You agree to comply with all applicable federal, state, and local laws, regulations, and ordinances regarding the purchase, possession, and use of firearms, ammunition, and related products. You acknowledge that it is your responsibility to be aware of and follow all laws regarding firearm ownership and use in your jurisdiction. 

We reserve the right to cancel any orders or suspend any user accounts if we determine that the transaction is in violation of any applicable laws or regulations. 

10. Prohibited Uses

You agree not to use our website or Services for any unlawful or prohibited activities, including but not limited to: 

• Using the website for any fraudulent, illegal, or harmful purposes. 

• Violating the intellectual property rights of others. 

• Engaging in activities that could damage, disable, or overburden the website or interfere with other users’ ability to use the website. 

We reserve the right to suspend or terminate your access to the website if we suspect you are violating any of these prohibitions. 

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or the purchase of products from us, including but not limited to loss of profit, data, or business. 

Our liability is limited to the total amount you paid for the product in question. 

In addition, we are not liable, in any way, monetarily or otherwise, for any damage to personal property, injury, or loss of life due to the improper use of any firearm or other product purchased from our site. Improper uses include but are not limited to accidental or negligent discharges, unsafe operation, or illegal actions. 

12. Indemnification

You agree to indemnify, defend, and hold harmless PCF Guns and Gear (Poverty Creek Firearms), its officers, directors, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the website, violation of these Terms, or infringement of any rights of a third party.

We reserve the right to update or modify these Terms at any time, with changes becoming effective immediately upon posting on our website. We encourage you to review these Terms periodically for any updates or changes. Your continued use of the website after any changes to the Terms constitutes your acceptance of those changes. 

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Georgia, USA, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the competent courts located in Lumpkin County, Ga.
